These Terms of Service ("Terms") govern your access to and use of the website located at quantusinsights.org and any content, tools, or services provided on or through it (collectively, the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

Quantus Insights provides polling and survey research, election forecasting and modeling, economic and political analysis, and related commentary and consulting. Our Site presents articles, research summaries, model outputs, visualizations, and contact forms for prospective clients and readers.

You must be at least 13 years old to use the Site. If you are under the age of majority in your jurisdiction, you may only use the Site with the consent of a parent or guardian. The Site is primarily directed to audiences in the United States, but it is accessible worldwide. You are responsible for compliance with local laws where you access the Site.

We may update the Site, discontinue features, or modify these Terms at any time. The "Effective date" above tells you when these Terms last changed. Your continued use of the Site after a change means you accept the updated Terms.

All content on the Site, including text, graphics, logos, charts, models, forecasts, polls, and compilations (collectively, "Content"), is owned by Quantus Insights or our licensors and is protected by applicable intellectual property laws. We grant you a limited, revocable, nonexclusive, nontransferable license to access and view the Content for your personal or internal business use. Except as allowed by law, you may not copy, reproduce, distribute, publicly display, modify, create derivative works of, or otherwise exploit the Content without our prior written permission.

You may quote short excerpts from articles or reports for commentary, criticism, research, or news reporting, provided you include clear attribution to "Quantus Insights" and a link to the relevant page on quantusinsights.org. This permission does not include the right to reproduce charts or model outputs in full, to scrape or republish datasets, or to use Content in advertising or promotional materials without written permission.

The Site provides analysis and forecasts for informational and educational purposes only. The Content is not investment advice, legal advice, or professional advice of any kind. Forecasts and polling aggregates reflect assumptions and data that can change. We do not guarantee the accuracy, completeness, timeliness, or outcomes suggested by any model or analysis.

You agree not to:

• access, query, or copy the Site using automated means, including bots, scrapers, or spiders, except for public search engine indexing in accordance with our robots.txt;
• circumvent security or rate limits, probe or test the vulnerability of any system or network, or interfere with the proper working of the Site;
• upload or transmit any malware, malicious code, or harmful content;
• use the Site to violate any law or the rights of others, including intellectual property and privacy rights;
• misrepresent your affiliation with any person or entity, or impersonate any person.

If you submit information, ideas, feedback, or materials to us, including via contact forms or email (collectively, "Submissions"), you represent that you have the right to do so. You grant Quantus Insights a worldwide, royalty free, irrevocable, perpetual license to use, reproduce, modify, and create derivative works from your Submissions, for the purpose of operating and improving the Site and our services. This section does not limit the data protection commitments in our Privacy Policy.

The Site may include links to or integrations with third party platforms, such as social networks, video hosts, newsletter platforms, analytics, and security tools. Those sites and services are governed by their own terms and policies. We are not responsible for their content or practices.

We respect intellectual property rights. If you believe Content on the Site infringes your copyright, please send a notice to our DMCA Agent that includes: (a) your signature, (b) identification of the copyrighted work, (c) identification of the material claimed to be infringing and its location, (d) your contact information, (e) a statement that you have a good faith belief that use of the material is not authorized, and (f) a statement that the information in your notice is accurate, and under penalty of perjury, that you are authorized to act for the owner.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR FREE OR UNINTERRUPTED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUANTUS INSIGHTS AND ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS.

You agree to defend, indemnify, and hold harmless Quantus Insights and our owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of another.

We may suspend or terminate your access to the Site at any time if we believe you have violated these Terms or if we discontinue the Site. You may stop using the Site at any time. Sections that by their nature should survive termination will survive, including Sections 4 through 17.

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in San Diego County, California for any dispute not subject to arbitration.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Site that cannot be resolved informally will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration will take place in San Diego County, California, in English, before a single arbitrator. You and we agree to bring claims only in your or our individual capacity, not as a plaintiff or class member in any class or representative proceeding. You may opt out of this arbitration agreement by sending a written notice to contact@quantusinsights.org within 30 days of your first use of the Site after the Effective date.

You may not use the Site if you are located in a country or are a person subject to U.S. embargoes or sanctions, or if your use would violate export control laws.

Contact Text Message Terms & Conditions

By requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, or otherwise consenting to receive one or more text messages from Quantus Insights (“Sender”, “we”, “us”, “our”) through Sender’s messaging platform (“Platform”), you accept these Terms & Conditions (“Opt-In”).

Opting In

You authorize Sender to use auto dialer or non-auto dialer technology to send text messages to the cell phone number associated with your Opt-In (i.e., the number listed on the Opt-In form or instructions, or, if none, the number from which you send the Opt-In, or, if none, the number on file for the account associated with your Opt-In). You also authorize Sender to include marketing content in any such messages. You do not have to Opt-In or agree to Opt-In as a condition of purchase of any of Sender’s offerings.

You confirm that you are the subscriber to the relevant phone number or that you are the customary user of that number on a family or business plan and that you are authorized to Opt-In.

You consent to the use of an electronic record to document your Opt-In.

You agree that, in addition to the main messages that Sender may provide, you may receive one or more welcome messages or administrative messages, such as (in some cases) a request to confirm your Opt-In.

About the Text Message Services and Opting Out

Message and data rates may apply. You must have a wireless device of your own, capable of two-way messaging, be using a participating wireless carrier, and be a wireless service subscriber with text messaging service. Not all cellular phone providers carry the necessary service to participate. Check your phone capabilities for specific text messaging instructions.

Unless otherwise noted, Sender may send multiple, recurring messages and frequency may vary. Sender may terminate any messaging services or your participation in it at any time with or without notice, including, for example, before you have received any or all messages that you otherwise would have received, but these Terms & Conditions still will apply. Your opt-out request will generate a confirmation text.

You consent to the handling of your information as described in our Privacy Policy. To contact Sender customer service, at contact@quantusinsights.org.

You may text STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to opt-out of messages or for additional help, text HELP. You also understand and agree that any other method of opting out, including, but not limited to, texting words other than those set forth above or verbally requesting one of our employees to remove you from our list, is not a reasonable means of opting out. You may receive an additional mobile message confirming your decision to opt out. These Terms & Conditions still will apply if you withdraw the consent mentioned above.

To request a free paper or email copy of the Opt-In, or to update our records with your contact information, or receive help with any messages, please contact us at contact@quantusinsights.org. Minimum technology requirements may apply for electronic records.

You may not use or engage with the Platform if you are under thirteen (13) years of age. If you use or engage with the Platform and are between the ages of thirteen (13) and eighteen (18) years of age, you must have your parent’s or legal guardian’s permission to do so. By using or engaging with the Platform, you acknowledge and agree that you are not under the age of thirteen (13) years, are between the ages of thirteen (13) and eighteen (18) and have your parent’s or legal guardian’s permission to use or engage with the Platform, or are of adult age in your jurisdiction. By using or engaging with the Platform, you also acknowledge and agree that you are permitted by your jurisdiction’s applicable laws, rules, and regulations to use and/or engage with the Platform.
